Terms and Conditions
§ 1 General and contractual basis
(1) The following Terms and Conditions govern the contractual relationship between dr.reinwald vital ltd., Lord Byron Street 61–63, 5th Floor, CY-6023 Larnaka, Tel. +49 (0)9187 808780, Fax +49 (0)9187 8087829, Email shop@drreinwald.de (hereinafter “Seller”) and the customer for the sale of dr.reinwald vital products via the dr.reinwald vital online shop and via other online sales channels.
(2) Different rules apply in part for consumers and business customers. Therefore, these Terms and Conditions explicitly distinguish between consumers within the meaning of Section 13 German Civil Code (BGB) and entrepreneurs within the meaning of Section 14 BGB where relevant. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside his or her trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of his or her trade, business or profession.
(3) These Terms and Conditions in the version valid at the time of conclusion of the contract apply to all contracts for the supply of goods that are concluded exclusively by means of distance communication.
§ 2 Conclusion of contract
(1) The presentation of products in the dr.reinwald vital online shop does not constitute a binding offer to conclude a purchase contract. It is only an invitation to submit an offer. By clicking the button “Buy now”, you submit a legally binding offer to conclude a purchase contract within the meaning of Section 433 BGB. After completing the order, you will receive an automatically generated email confirming receipt of your order and listing the details (order confirmation). This confirmation is not yet an acceptance of your offer. A purchase contract for the ordered goods is only concluded when we accept your offer by sending you a separate email containing the invoice, payment information (depending on the chosen payment method) and, where applicable, the information that your goods have been handed over to our shipping department.
If the offer is not accepted within 2 days (Section 193 BGB; Saturdays, Sundays and public holidays are not counted), it is deemed to be rejected and the customer is no longer bound by it.
(2) To place a binding order using the Seller’s online shopping cart system, the customer adds the selected items to the virtual shopping cart by clicking the button “Add to cart”. The customer can open the cart at any time via the “Checkout” or “Cart” button and make changes. Once the customer has placed the desired items in the cart, he or she proceeds via the shopping cart to the checkout page. There, the customer can choose between ordering as a guest, creating a customer account or logging into an existing account. After entering the personal data, the customer selects the shipping method and payment method. The following page shows an order overview where all details can be checked again and, if necessary, changed (for example via “Edit” buttons at the fields or by using the browser’s back function) or the order can be cancelled (e.g. by closing the browser window). The order process is only completed when the customer clicks the button “Buy now”.
(3) The Seller does not store the order data and the contract text in a way that allows the customer to access them again later. If the customer wishes to keep a record, he or she can copy, print or otherwise save the order details before submitting the binding order.
(4) If the customer chooses PayPal as the payment method, the contract between the customer and the Seller is concluded, by way of derogation from § 2 (1), already when the customer clicks the button “Buy now”. At the end of the order process, the PayPal input page appears, where the customer enters the email address and password registered with PayPal. Once the customer confirms the payment, the purchase price for the selected products, including any shipping costs, is credited directly to the Seller’s PayPal account. The goods are shipped at the latest within two working days after the payment instruction, i.e. once payment has been received.
(5) The customer may also submit an offer to the Seller by telephone, fax, email or post.
§ 3 Retention of title
The delivered goods remain the property of dr.reinwald until full payment has been received. Pledging or transfer by way of security before transfer of ownership is not permitted. The customer is obliged to inform the Seller immediately if third parties assert rights to the goods.
§ 4 Payment terms
All prices stated are final consumer prices and include German statutory VAT. Delivery is made against a selection of available payment methods. Not all payment methods are available in all countries.
For orders by email, telephone or fax we offer:
Direct debit (Germany and Austria only)
Convenient and fast. Simply provide your bank details when placing your order to authorize a one-time direct debit for this order. Your goods will then be forwarded directly to our shipping department.
PayPal (available internationally)
Convenient and fast. Your goods will be forwarded directly to our shipping department. During checkout you will be redirected to PayPal. Then simply follow the instructions provided by PayPal.
If the customer selects PayPal as payment method, payment processing is carried out by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg. The terms of use of PayPal (Europe) S.à r.l. et Cie, S.C.A. apply and can be viewed by customers with a PayPal account at: www.paypal.com/de/webapps/mpp/ua/useragreement-full. If the customer does not have a PayPal account, the “Terms for payments without a PayPal account” apply, which can be viewed at: www.paypal.com/de/webapps/mpp/ua/privacywax-full.
Prepayment (available internationally)
Please transfer the amount shown on your order confirmation within 8 days (from abroad within 10 days) to our bank account. The period begins on the day after the contract is concluded (§ 2 (1)). Please state your order number as the reference and, if you are not the account holder, your name as well. The delivery period begins two working days after you have instructed your bank to make the transfer. The bank details of dr.reinwald vital are shown on the invoice.
For orders in our online shop we may additionally offer:
PayPal “Purchase on account” (where available)
If the customer chooses PayPal “Purchase on account”, the “General Terms and Conditions for the use of PayPal purchase on account” apply in addition, available at: www.paypal.com/de/webapps/mpp/ua/pui-terms. The Seller transmits customer data to PayPal (Europe) S.à r.l. et Cie, S.C.A., which uses them to carry out a credit check. If PayPal (Europe) S.à r.l. et Cie, S.C.A. approves the customer’s purchase on account, the Seller assigns the purchase price claim to PayPal (Europe) S.à r.l. et Cie, S.C.A., which accepts the assignment. The customer can now only make payments with debt-discharging effect to PayPal (Europe) S.à r.l. et Cie, S.C.A. The customer is obliged to pay the invoice amount to PayPal (Europe) S.à r.l. et Cie, S.C.A. within 14 days after receipt of the goods. The assignment relates only to payment of the invoice amount; all other obligations from the contract (e.g. warranty, delivery, right of withdrawal, returns, customer service) remain with the Seller.
If the credit check is negative, the Seller reserves the right to refuse PayPal “Purchase on account” and to offer another payment method instead.

§ 5 Delivery
(1) Delivery will be made within a maximum of five working days after the contract has been concluded (see § 2 (1)), unless a different delivery time is explicitly stated in the product description or has been agreed. For prepayment orders, the delivery period begins two working days after the customer has instructed their bank to make the transfer. There are no deliveries on Sundays and public holidays.
As a returning customer, please ensure that the data stored in your shop account are correct and up to date. A different delivery address must be entered during the shop order or communicated to us immediately by email; otherwise it cannot be taken into account. Any additional costs incurred (e.g. due to returns and re-shipping) will be borne by the customer.
The customer must also ensure that the email address stored with the Seller is correct and that emails can be received at that address (in particular that they are not blocked by a spam filter) so that the information required for the contract can be delivered.
(2) Shipping is handled worldwide by DHL. The maximum weight is 31 kg per parcel. Please observe the weight specifications of the respective shipping price categories. Import duties or customs charges may apply in non-EU countries.

§ 6 Transfer of risk
If the customer is a consumer (see § 1), the risk of accidental loss or accidental deterioration of the goods remains with dr.reinwald until the goods are handed over to the customer. Handover is deemed equivalent if the customer is in default of acceptance.
If the customer is an entrepreneur (see § 1), the risk of accidental loss or accidental deterioration of the goods passes to the customer as soon as the goods are handed over to the carrier, freight forwarder or other person designated to carry out the shipment.
§ 7 Warranty / duty to inspect
(1) You always receive new goods. If you nevertheless have reason for a complaint, please contact us – preferably by email – and describe your complaint. We take every complaint seriously and try to identify the causes in order to avoid such errors in the future. In all cases covered by statutory warranty law, we will either provide a replacement quickly and straightforwardly or refund the purchase price as well as all shipping costs for the outward and return shipment.
For consumers, the warranty period for new goods is two years from transfer of risk. The transfer of risk to the consumer takes place when the goods are received.
For entrepreneurs, the warranty period for all products supplied by dr.reinwald is one year from delivery of the goods.
In all other respects, the rights in case of defects are governed by the statutory provisions.
(2) The shortened or excluded warranty periods in § 7 (1) do not apply in cases of liability for damages resulting from injury to life, body or health. The same applies to damages caused by gross negligence or intent on the part of the Seller or its vicarious agents, in cases of fraud, in recourse claims under Sections 478, 479 BGB, and for guarantees assumed by the Seller.
(3) If the customer is an entrepreneur within the meaning of Section 14 BGB, he or she must inspect the goods without delay after receipt and notify dr.reinwald of any defects immediately (Section 377 German Commercial Code (HGB)). If the customer fails to give such notice, the goods are deemed to be approved, unless the defect was not apparent during the inspection. Timely dispatch of the notification is sufficient for compliance with the deadline. If a defect becomes apparent later, the notification must be made immediately after its discovery.
§ 8 Transport damage
If goods are delivered with obvious transport damage, we kindly ask you to report this to the employee of the transport company and to document the damage with photos or other suitable means. Please also inform us immediately about the transport damage. This is a non-binding request and only serves to help us assert our claims against the transport company. Your statutory warranty rights remain unaffected if you do not follow this request.
Hidden defects and shortages must be reported by the customer to the Seller without delay, at the latest within 3 days after discovery.
§ 9 Information on the right of withdrawal for consumers
A right of withdrawal applies only to purchase contracts within the EU. If you are a consumer within the meaning of Section 13 BGB, i.e. if you are purchasing the goods for purposes that are predominantly outside your trade, business or profession, you have a right of withdrawal as set out below.
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day
- on which you or a third party named by you who is not the carrier have taken possession of the last goods, if you ordered several goods as part of a single order and these are delivered separately.
To exercise your right of withdrawal, you must inform us (dr.reinwald vital ltd., Lord Byron Street 61–63, 5th Floor, CY-6023 Larnaka, Email: shop@drreinwald.de, Tel. +49 9187 80878 0, Fax +49 9187 80878 29) of your decision to withdraw from this contract. You may use the model withdrawal form provided for this purpose, but it is not mandatory. To meet the withdrawal deadline, it is sufficient that you send your notification of exercising the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we received the notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.
You must send back or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you informed us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of 14 days has expired.
You bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods if this loss in value is due to handling of the goods that is not necessary to check their condition, properties and functioning.
Exclusion of the right of withdrawal:
- Contracts for the supply of goods which are liable to deteriorate or expire rapidly.
Premature expiry of the right of withdrawal:
- Contracts for the supply of sealed goods which are not suitable for return for health protection or hygiene reasons, if their seal has been removed after delivery.
- Contracts for the supply of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.

§ 10 Returns
If you exercise your right of withdrawal, you must bear the cost of returning the goods. In your own interest, please avoid sending goods back “carriage unpaid” (unfrei). Since you must bear the return costs yourself in any case, the significantly higher costs of an unpaid shipment compared to a standard shipment would be deducted from your refund.
§ 11 Data protection
dr.reinwald takes the protection of its customers’ data seriously. Our privacy policy can be accessed on our website under the corresponding “Privacy Policy” section.
§ 12 Final provisions
Cypriot law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which the consumer has his or her habitual residence.
If the customer is an entrepreneur, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is Cyprus.
